Privacy Notice for the processing of personal data - Information Memo pursuant to Article 13 of Legislative Decree No.196 of 30 June, 2003

This page describes the procedures for administering the website related to the processing of its users' personal data.
In compliance with Legislative Decree No. 196 of 30 June 2003 (Privacy Code) as amended, we hereby provide mandatory information related to the processing of personal data furnished by you. The privacy notice does not apply to any other websites that may be accessed using links contained on websites under the domain of the Data Controller who may not be held responsible for third party websites on any basis whatsoever.
This privacy notice is provided pursuant to Article 13 of Legislative Decree No. 196/2003 - the Personal Data Protection (Privacy) Code. The privacy notice is also based on Recommendation No. 2/2001 which the European personal data protection authorities, meeting in the Group established under Article 29 of Directive 95/46/EC, adopted on 17 May 2001 to identify certain minimum requirements for gathering personal data online and, in particular, the procedures, timing and nature of the information which Data Controllers are required to provide to users accessing web pages, irrespective of the purposes of such access, and is also based on the provisions of Directive 2002/58/EC, as updated by Directive 2009/136/EC, relating to Cookies, and also by the provisions of the Personal Data Protection Authority ruling of 08.05.2014 relating to cookies, entitled<< Identification of simplified procedures for the privacy notice and obtaining consent for the use of cookies>>

1. The "Data Controller” of the data processing

2. Type of data processed

Personal data and identification data.
Personal data means any information associated with a natural person that is or can be identified, even indirectly, by reference to any other information, including a personal identification number. Identification data means personal data which enables a data subject to be identified directly (for example, name, surname, date of birth, address, email address, telephone number, etc.

Navigation data
The computer systems and software procedures used in the operation of this website gather specific personal data during their normal operation, whose transmission is implicit in the use of internet communication protocols.
This information is not gathered in order to be associated with specific data subjects, but could enable users to be identified by means of data processing and association with data held by third parties.
This category includes IP addresses or domain names associated with computers used by persons accessing the website, addresses in URI (Uniform Resource Identifier) notation of the resources requested, the time of the request, the method used to submit the request to the server, the file size obtained in response, the numeric code indicating the server response status (successful, error, etc.) and other parameters related to the user's operating system and computer environment.
The data could be used for the purposes of establishing liability in the event of computer crimes which harm the website.

Data voluntarily provided by the user
The transmission of emails to the addresses specified on this website (on an optional, explicit and voluntary basis), or the filling out of forms which involve the collection of data, will mean that the sender’s email address will be subsequently acquired in order to effectively respond to the user’s request, as will any other personal data entered.

3. Purposes of the data processing

Personal data voluntarily provided will be processed for the following purposes, until any objection is made to such processing:

For the purposes of application of personal data protection rules, data-processing activities for administrative-accounting purposes are associated with the performance of organisational, administrative, financial and accounting activities irrespective of the nature of the data processed. In particular, those purposes are sought to be achieved by internal organisational activities related to compliance with contractual and pre-contractual obligations, information activities.

4.Nature of the provision or withholding of information

Apart from the provisions applicable to navigation data, the user may provide personal data by making contact with the offices of Mollificio Adda S.r.l., in order to request the transmission of information material or other communications.
The provision of the data is optional but necessary. The failure to provide such data may make it impossible to obtain what has been requested or to use the Data Controller's services

5. Data processing methods

Personal data are processed using automated electronic tools only for the period of time that is strictly necessary to achieve the purposes for which such data have been gathered.
Specific security measures are applied to prevent the loss or unlawful or incorrect use of the data, as well as unauthorised access thereto.

6. Sphere of data communication and dissemination

Your processed data will not be generally disseminated and may be disclosed to companies contractually associated with Mollificio Adda S.r.l. within the European Union, in conformity with and within the limits of Article 42 of Legislative Decree No. 196/2003, in order to ensure compliance with contractual obligations or related purposes. The data may be disclosed to third parties who belong to the following categories:

  • suppliers of services in charge of managing the information system used by Mollificio Adda S.r.l. and the telecommunications networks, including e-mail and website management;
  • advisory or consultancy offices or companies;
  • authorities in charge of compliance with legal obligations and/or measures of public bodies, upon request.

The parties which belong to the aforementioned categories act as Data Supervisors, or they act in full independence as separate Data Controllers. Any other data disclosure or dissemination will require your prior explicit consent.

7. Rights of Data Subjects

Pursuant to Articles 7, 8, 9 and 10 of Legislative Decree No. 196 of June 30 2003, data subjects are entitled at any time to obtain confirmation of the existence or otherwise of such data and to know the content and origin thereof, to verify their accuracy or request that they be supplemented or updated or corrected (Article 7 of the Personal Data Protection (Privacy) Code).
The data subject is entitled, under the same article, to request the deletion, anonymisation or blocking of data processed in violation of the law, and in any case to object for legitimate reasons to the processing of such data.

8. Changes to privacy policy

The Data Controller reserves the right to change, update, add or remove parts of this privacy statement at its discretion, at any time. The data subject is required at regular intervals to check any changes. The privacy notice will specify the date on which it is updated, in order to facilitate the aforementioned checks. The user's use of the website after the publication of those changes shall constitute acceptance thereof.
